UNITED STATES OF AMERICA, acting through the Rural Housing Service, Usda, F/K/A The Farmers Home Administration, PAINTIFF vs. MAHDY ARYAMAND, DEFENDANT
On Motion of the Plaintiff for an Order for Service by Publication of the Complaint for Foreclosure on the Defendant, Mahdy Aryamand, pursuant to M.R. Civ. P. 4(g), it appearing that this is an action to foreclose a mortgage from Mahdy Aryamand and Tahereh Khansari Nejad dated August 15, 2005, and recorded in the Cumberland County Registry of Deeds in Book 23022 Page 097, on premises located at 298 Shaker Road in Gray, Maine.
It further appears, and the Court so finds, that personal service of the Complaint cannot be made upon the Defendant, Mahdy Aryamand, any other way, inasmuch as his present whereabouts is unknown and cannot with reasonable diligence be established, it is hereby ORDERED that service be made upon the Defendant, Mahdy Aryamand, by publishing this Order once a week for three consecutive weeks in The Bridgton News, a newspaper of general circulation in Cumberland County. The first publication shall be made within twenty (20) days after the Order is granted. Service by publication shall be complete on the twenty-first day after the first publication. Within twenty (20) days after service is completed by the foregoing method, the Defendant, Mahdy Aryamand, shall appear and defend this action by filing an answer with the Clerk of the Maine District Court at P. O. Box 412, Portland, ME 04112, and also by serving a copy of the answer on Plaintiff’s attorney, Richard H. Broderick, Jr., Esq., at P. O. Box 5, Lincoln, Maine 04457. If he fails to do so a judgment by default will be rendered against him for the relief demanded in the Complaint.

NOTICE OF SCHOLARSHIPS AVAILABLE
Lovell
Lovell residents attending, or planning to attend, a school of postsecondary education (whether liberal arts or vocational) are invited to apply. The Warren B. and John W. McKeen Educational Foundation will be awarding a number of scholarships to such students who have been Lovell residents for at least one year. TOWN OF LOVELL
Planning Board – Public Hearing
The Lovell Planning Board will hold a Public Hearing on proposed revisions to the Lovell Zoning Ordinance on January 6, 2016, at the Town Office, starting at 7:00 p.m. The revisions are in three parts:
1) Article II, Definitions — amendment of the definition of “Functionally Water-Dependent Uses‚ to exclude boat houses from the definition.
2) Article V, General Provisions — including:
a) A statement of the responsibility of the Planning Board in dealing with nonconformities;
b) Revised standards or existing structures which are nonconforming as to setback required from lakes and streams.
3) Clarificaton of Planning Board responsibility to reach a timely decision on a conditional use application when no public hearing is to be held.
Following the hearing there will be a public discussion on the need for a town signboard.
Copies of the proposed ordinance revisions are available at the town office.

Winter Parking Ban
From November 20, 2015 – April 15, 2016, no vehicle shall be parked on any public street or way from 11:00 p.m. to 7:00 a.m. as per MRSA 29A Section 2068-2069 and the Bridgton Traffic Ordinance adopted January 10, 1995, and amended August 27, 1996, and October 25, 2005. A town-wide parking ban may be called for with notification. Vehicles may be towed at owner’s expense.

Notice to Person(s) Plowing Driveways within the limits of the Town of Bridgton, Maine:
Warning is hereby given that no person or persons shall plow, shovel or otherwise deposit snow, or cause the same to be done, into the limits of any traveled public way within the Town of Bridgton.
It is permissible to plow the snow bank left by the street plow directly in front of a driveway to each side of the driveway onto the snow bank.
Pursuant to MRSA 17A, Section 505, “Placing Obstructions on a Traveled Road†and MRSA 29A Section 2396 “Snow, a person may not place and allow to remain on a public way snow or slush that has not accumulated there naturally.†Persons in violation of these laws shall be subject to legal action.

Winter Parking Ban
To aid in the removal of snow from November 15, 2015 through April 15, 2016, no vehicle shall be parked on any public street or way from 10:00 p.m. to 6:00 a.m., as per MSRA, Title 29-A Section 2068 and 2069, and the Town of Fryeburg Traffic Ordinance. Violators will be subject to a fine as defined in the Town Traffic Ordinance, and vehicles may be towed at the owner’s expense if they interfere with plowing or snow removal operations.

Please take notice that, pursuant to 38 MRSA, Sections 413 and 414-A, Maine Pure of 70 Porter Road, Fryeburg, Maine 04037, intends to file an application with the Maine Department of Environmental Protection (DEP). The application is for the discharge of 1,500 gallons per day of treated bottle wash water via a subsurface infiltration field in Fryeburg, Maine. Wards Pond is the receiving water for groundwater in this area.
The application will be filed on or about July 10, 2015, and will be available for public inspection at DEP’s Augusta office during normal business hours. A copy may also be seen at the municipal offices in Fryeburg, Maine.

The Town of Bridgton is requesting bids for renovations to the Town Hall, located at North High Street in Bridgton, Maine. Explanation: Non-state-funded debt service is the amount of money needed for the annual payments on the District’s long-term debt for major capital school construction projects that are not approved for state subsidy. The bonding of this long-term debt was previously approved by the voters of the District.
Article 15: Additional Local Funds: (Written ballot required). To see what sum Maine School Administrative District No. 61 will raise and appropriate in additional local funds (Recommend $4,676,661) which exceeds the State’s Essential Programs and Services funding model by $4,260,960 as required to fund the budget recommended by the Board of School Directors.
The Board of School Directors recommends $4,676,661 for additional local funds and gives the following reasons for exceeding the State’s Essential Programs and Services funding model by $4,260,960:
1.$459,519 is the Teacher Retirement piece at 3.36%, that was previously paid by the State.
2.Co-curricular and Extra-curricular activities: The State has supported an average of 10% statewide; SAD 61 receives about 9%.
3.Additional staffing district wide: staffing above the EPS minimums in the following areas: teachers, clerical, educational technicians (permanent substitutes), guidance and administration and seven workshop days per teacher and four workshop days per educational technician are not covered under the EPS formula.
4.Substitute pay: The State allocates half a day per student. This does not cover long-term absences due to lengthy medical leaves for long-term illnesses or for maternity leave where substitutes are paid at a higher rate.
5.Operations/maintenance of seven (7) District facilities: This includes the local portion of the Songo Locks School modular which is partially subsidized by the State.
6.Transportation: (includes special education transportation). This amount would encompass late buses, summer school, bus driver workshop days and our bus safety program.
7.Special Education: This additional amount is partly due to year-old student information, summer school, scheduling and reduced financial support at the Federal and State levels.
8.Technology: This includes the District initiative to provide laptops to every student grades six (6) through twelve (12), (of which grades seven (7), eight (8) and teachers grades seven (7) through twelve (12), are paid by the State); make computer labs available at the K-5 grade level and to support technology integration into the core learning areas including, English, Math, Science and Social Studies.
Explanation: The additional local funds are those locally raised funds over and above the District’s local contribution to the total cost of funding public education from kindergarten to grade 12 as described in the Essential Programs and Services Funding Act and local amounts raised for the annual payment on non-state funded debt service that will help achieve the District’s budget for educational programs.
ARTICLES 16 TO 17 RAISE FUNDS FOR OTHER PROGRAMS SUPPORTED BY THE SCHOOL BUDGET
Article 16: Community Use Of Facilities. (Written ballot required). In addition to the amount in Article 15, shall Maine School Administrative District No. 61 raise $50,000 in additional local funds to keep District facilities open for community and other programs on Saturdays and school vacations, which sum exceeds the State’s Essential Programs and Services model by $50,000?
The Board of School Directors recommends a “YES†vote for the following reasons: The cost to keep SAD 61 facilities open for community and other uses on Saturdays and school vacations is not included in the State’s Essential Programs and Services funding model.
Explanation: The additional local funds are those locally raised funds over and above the District’s local contribution to the total cost of funding public education from kindergarten to grade 12 as described in the Essential Programs and Services Funding Act and local amounts raised for the annual payment on non-state funded debt service that will help achieve the District’s budget for educational programs.
Article 17: Food Service Program: Shall Maine School Administrative District No. 61 raise $50,000 in additional local funds for the support of the Food Service Program?
The Board of School Directors recommends a “YES†vote.
ARTICLE 18 SUMMARIZES THE PROPOSED SCHOOL BUDGET
Article 18: Total School Budget Summary. Light Manufacturing: The mechanical or chemical transformation of materials or substances into new products, either finished or semi-finished, and including the assembling of component parts, the manufacturing or products and the blending of materials. All production operations shall occur within a fully enclosed building or structure.
2015 AMENDMENTS TO THE TOWN OF NAPLES ZONING ORDINANCE
The Town of Naples Zoning Ordinance shall be amended as follows (additions are underlined and deletions are struck out):
3.1 Establishment of Districts
The Town of Naples is hereby divided into the following Districts:
3. Commercial:
The area where future commercial development outside of the village district shall take place. Residential use, except for mobile home parks, will be allowed in the cCommercial areazoning district. Light manufacturing is allowed in the Commercial zoning district subject to the limitations set forth in Section 3.6.
3.6Â Limited Allowance of Light Manufacturing in Commercial District
Light manufacturing use is allowed with Planning Board site plan review and approval in those portions of the Commercial zoning district with (i) frontage along State Route 11 or (ii) frontage on Route 302 and located north of the Village District, subject to the following standards:
A. Space and Bulk Standards
Minimum lot size Five acres
Minimum frontage on State Route 11 200 feet
Front setback (principal and accessory buildings or structures)50 feet
Minimum side and rear setbacks (principal and accessory buildings or structures)50 feet
Maximum height (principal and accessory buildings or structures)55 feet
Maximum footprint of principal building or structure 20,000 square feet
Maximum combined total footprint of all accessory buildings or structures 10,000 square feet
Maximum impervious surface 50 percent
B. Development Standards
1. Streetline landscaped area: A strip of land not less than 25 feet in width shall be maintained as a vegetated area adjacent to the front property line. This area shall be appropriately landscaped and maintained as a vegetated area. Where tree lines exist along existing streets or roads, an effort shall be made to preserve this feature and suitable provisions made to protect it through deed covenants or easements. This vegetated area shall not be used as parking, for the storage or display of materials, or for the location of dumpsters or similar items. Access drives may cross this area, but drives or accessways providing internal circulation shall not be located within this area.
2. Residential buffer: A 50 foot buffer strip shall be maintained along any lot line adjoining a lot being used for residential purposes. This buffer strip shall be maintained as a vegetated area and shall not be used as parking, for the storage or display of materials, or for the location of dumpsters or similar items. A visual barrier shall be established within the buffer strip by landscaping and/or fencing.
C. Performance Standards
Light manufacturing uses shall conform to all site plan review standards, plus the following:
1. Enclosure of all production operations: All production operations shall occur within a fully enclosed building or structure.
2. Storage: No equipment, materials or derelict vehicles shall be stored on the site unless they are enclosed within a secure area and screened from view from public streets and adjacent properties.
3. Vibration: Equipment and other activities shall not produce vibration measured at the lot line which is perceptible without instruments. In no case shall vibration at the lot line exceed .003 of one inch.
4. Odors: No offensive, harmful or noxious odors shall be emitted that create a public nuisance or hazard beyond the lot line of the parcel.
5. Electromagnetic interference: No electromagnetic interference shall be permitted that does not conform to State and federal standards.
6. Off-street parking:
a) Off-street parking shall be located on the same lot with the principal building. Parking areas shall be arranged so that it is not necessary for vehicles to back into the street.
b) Parking stalls and aisle layout shall conform to the standards in Table 1 of this subsection.

(c) In parking lots utilizing a parking angle of 90 degrees, thirty percent (30%) of the spaces shall be created with a stall width of 10’-0†and a stall depth of 20’-0â€. Remaining spaces shall be created with a stall width of at least 9’-0†and a stall depth of a least 18’-0â€.
(d) In lots utilizing diagonal parking, the direction of proper traffic flow shall be indicated by signs, pavement markings or other permanent indications and maintained as necessary.
(e) A minimum of 1.5 parking spaces per 500 square feet of floor area shall be provided, but in no case less than one space for every two employees.
(f) The closest boundary of the parking area shall be within 300 feet of the principal building for which the spaces are required.
(g) Five percent (5%) of the total parking area, including maneuvering areas but not including access roads which are not a part of the parking area itself, shall be landscaped and maintained with trees, shrubs, and other natural vegetation, in a manner approved by the Planning Board.
(h) The surface of driveways, maneuvering areas and parking areas shall be uniformly graded with a subgrade consisting of gravel or equivalent materials at least six (6) inches in depth, well compacted and with a wearing surface equivalent in qualities of compaction and durability to fine gravel.
(i) A system of surface drainage and erosion control shall be provided in such a way that the water runoff shall be disposed of on the site of development and, to the extent practicable, done so through the wise use of the natural features of the site.
(j) Where artificial lighting is provided, it shall be shaded or screened so that no light source shall be visible from outside the area and its access driveways.
7. Off-street loading: Each loading bay shall have minimum dimensions of 50 feet by 14 feet and may be located either within a building or outside and adjoining an opening in the building. Every part of such loading bay shall be located completely off the street. In case trucks, trailers, or other motor vehicles larger than the dimensions of the minimum loading bay habitually serve the building in question, additional space shall be provided so that such vehicle shall park or stand completely off the street. All loading bays and waiting areas shall be screened.

Invitation to Bridgton Citizens – Committee Appointment – Land Use & Zoning (LUZ) Ad Hoc Committee – Bridgton, Maine
The Town of Bridgton is seeking applications for interested citizens to serve on a newly-created ad hoc committee titled Land Use & Zoning (LUZ) Ad Hoc Committee. This creation and subsequent appointment is pursuant to the Select Board Committee Policy Sections II.A.3 and III, respectively. The Land Use & Zoning (LUZ) Ad Hoc Committee is being formed to provide for safe, attractive and economically beneficial development throughout the municipality. The key elements of the Committee’s mission include reviewing the current land use regulations, current development practice, anticipated development trends, and land use models using the newly-approved Town of Bridgton Comprehensive Plan for direction. The role of the committee is to work with staff by confirming the land use policy and reviewing language for the development of ordinances and/or applicable regulations governing future development in Bridgton.
The Committee shall report to the Select Board at least quarterly on their work and progress. The Committee shall be comprised of not more than seven members and no less than three members. Members are appointed by the Select Board and will serve to the conclusion of the Committee’s charge. The Committee shall meet monthly at a minimum and no more than twice a month. Please be advised the hearing of the Town of Bridgton Select Board to discuss potential Public Facilities and Infrastructure projects utilizing Community Development Block Grant funds on January 27, 2015, at 6 p.m., has been postponed to February 10, 2015, at 6 p.m., due to inclement weather.
For example, previous funds have supported projects as Depot Street, the Town Hall and wastewater upgrades. The Board will discuss potential projects for the next fiscal year of funding beginning July 1, 2015. The public is invited to participate in this discussion.
The resulting list of potential projects will be reviewed by the Community Development Committee and their recommendation forwarded to the Board of Selectmen for final approval. It is not known, as of this writing, the amount of entitlement funds the town will receive.

To Discuss Public Facilities and Infrastructure Projects Utilizing the Community Development Grant Fund – Call for Public Input – Notice of Schedule
Please be advised the Town of Bridgton Select Board will discuss potential Public Facilities and Infrastructure projects utilizing Community Development Block Grant funds at a public hearing on January 27, 2015, at 6 p.m.
For example, previous funds have supported projects as Depot Street, the Town Hall and wastewater upgrades. The Board will discuss potential projects for the next fiscal year of funding beginning July 1, 2015. The public is invited to participate in this discussion.
The resulting list of potential projects will be reviewed by the Community Development Committee and their recommendation forwarded to the Board of Selectmen for final approval. It is not known, as of this writing, the amount of entitlement funds the town will receive.

Notice of Public Hearing
The Bridgton Water District will be filing a revised rate schedule with the Maine Public Utilities Commission to be effective April 1, 2015.
A public hearing will be held on January 26, 2015, at 5 p.m., at the Bridgton Water District. The purpose of this hearing is to present proposed water rates which are intended to increase the District’s annual revenues by $69,928. This represents and increase of 15.44% in total revenues. The increase is necessitated by increased debt service and operating costs since the last increase on January 1, 2004 (10 years ago).
Estimated increases by customer class follows. Increases within each group will vary according to usage. Public Fire protection has been increased to equal 30% of total revenue in accordance with PUC regulations, Chapter 690.

If, within 30 days of public hearing, 15% of the customers of the District file petitions with the Bridgton Water District trustees and the Maine Public Utilities Commission demanding a review of the rate changes by the Commission, the rate change may be suspended, investigated, reviewed and changed in accordance with Section 310. Signatures on the petition are invalid unless accompanied by the printed names and addresses of the signers. Upon request, the district will provide customers with the appropriate petition forms.
The revision in rates will be filed in accordance with 35-A-M.R.S.A., Section 6104. Data relating to the increase may be inspected at the Bridgton Water District office. Notice of Community Development Grant Fund Availability – Call for Applications – Notice of Schedule
Please be advised the Town of Bridgton is soliciting applications for the Town of Bridgton, Maine & Cumberland County Community Development Block Grant CDBG Program for FFY 2015.
There is a required workshop for service applicants on January 6, 2015, at either 10 a.m. or 2 p.m. Service applications are for those programs that serve persons of low to moderate income; other restrictions apply. The Board of Selectmen will discuss potential Public Facilities and Infrastructure projects utilizing these funds at a public hearing on January 13, 2015, at 6 p.m. The deadline to receive service applications is January 20, 2015, at or before 3 p.m. All service applicants must appear to provide an explanation of their program at the Community Development Committee meeting January 21, 2015, at 7 a.m. Applications will be reviewed by the Community Development Committee and forwarded to the Board of Selectmen for approval.
